Here comes the legal bit…

These Terms and Conditions apply to all transactions between us and yourself. They do not affect your statutory rights. Please read them carefully.

We may change the Terms and Conditions at any time. Any changes will take effect on the date they are posted on our website.

The Terms and Conditions are governed by English law and are subject to the non-exclusive jurisdiction of the English courts. We do not accept amendments to them.

Failure by us to enforce any of the Terms and Conditions will not affect our right to enforce the rest of the terms and conditions.

Customer Orders
The display of goods on www.whitenoisemachine.co.uk web site amounts to an invitation to treat only. It is not an offer to sell products or services at any price indicated. No acceptance for the supply of products or goods will be deemed to exist between you and The White Noise Machine Company unless, and until, an e-mail is sent by us to you confirming that your order has been accepted and payment has been successfully made.

This confirmation e-mail amounts to an acceptance by us of your offer to buy goods or services from us and this acceptance is effective regardless of whether or not you receive the e-mail.

The White Noise Machine Company is free to withdraw from a prospective contract at any time prior to acceptance. This also applies in the case of any error or inaccuracy in respect of the goods or services, any description applied to the goods or services, the price, the availability of the goods or services, or the order itself.

We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

To order goods on our website, you must be at least 18 years of age.  By ordering you are legally agreeing that you are over the age of 18.   Your order will be accepted and the creation of a legally binding contract between you and us will take place once the goods have been dispatched or collected. (Alternatively, we may decline all or part of your order for any reason, in which case we will inform you in-person or by telephone or e-mail).

When deciding whether or not to accept your order we may use certain information about you, including any received from credit reference agency checks. This helps to protect you and us against fraudulent transactions. We reserve the right to decline any order without explanation.

We will tell you if your payment details cannot be authorised for any reason and may invite you to pay by another method.

The total price payable will be stipulated at the time when you place your order whether or not the order has been acknowledged. We are entitled to make adjustments to the price to take account of any increase in our suppliers’ prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been acknowledged. We will inform you of the correct price and give you the opportunity to cancel the order. 

We do not charge VAT on your purchase and delivery charges are included in the total payable.

Order Processing

Your order is sent directly to our office for processing. Once we have received your order and payment, we will pick, pack and dispatch the item. We will aim to do this the same day for all orders before 2pm Mon-Fri (excl Bank Holidays).  Occasionally however same day dispatch may not always be possible.  When your order has shipped we will send you a confirmation email.


Security (Paypal)

We use the industry leading internet payment company Paypal to protect your card details and protect us from fraud. The following security systems are used.

Transaction security. All transaction information passed between us and Paypal is encrypted using 128-bit SSL certificates. No cardholder information is ever passed unencrypted and any messages sent to your servers from Paypal are signed use hashing to prevent tampering. You can be completely secure in the knowledge that nothing you pass to Paypal servers can be examined, used or modified by any third parties attempting to gain access to sensitive information.  The White Noise Machine Company does not receive your payment card details.

Encryption and Data Storage. All sensitive data is secured on Paypal using internationally recognised 256-bit encryption standards. The encryption keys are held on state-of-the-art, tamper proof systems, making them all but impossible to extract. The data we hold is extremely secure.

Links to banks. Paypal has multiple private links into the banking network that are completely separate from the Internet and which do not cross any publicly accessible networks. Any cardholder information sent to the banks and any authorisation message coming back is secure and cannot be tampered with.

Employee access. No individuals within The White Noise Machine Company or Paypal are able to decrypt transaction information or cardholder data. Our systems only allow access to our most senior staff and only in extenuating circumstances (such as investigations of Card Fraud by the Police). Your transaction information and customer card information is secure because our systems never display the full card numbers.

Delivery

Delivery options are listed below.

The Marpac 980A costs £59.99 including First Class Recorded Delivery (within the UK).

The Marsona 600A costs £89.99 including Next Day before 1pm Delivery (within the UK).

Once you have placed an order we will endeavour to dispatch your item/s as quickly as possible. Postal strikes may delay delivery.

If you are unavailable when Royal Mail attempts delivery, they will leave a card to offer you a collection from a local collection point.  If you should refuse delivery of goods, and the product is returned to us, you will be required to cover any extra costs incurred.  If you wish to cancel your order after it has been dispatched you are responsible for postal costs incurred returning the item to us.

All quoted delivery prices are for UK mainland addresses.  For international delivery costs please see the drop down menus on the Buy Online page.

We maintain the right to refuse to deliver to a secondary address. We use postcode verification procedures.
 

Availability

We aim to hold stock at all times and in the rare event that we are waiting for stock you will be contacted by email immediately and given the option of an immediate refund.

On occasions goods are subject to availability and delay in delivery of goods is sometimes outside our control. As such, delivery cannot be guaranteed and any dates we specify for the delivery of the goods are approximate only. We shall not be liable for any losses, costs, damages, charges, or expenses caused by any delivery delay.


Returns

We appreciate that in shopping online you are unable to see and handle the products that you buy. Therefore if you are in anyway unhappy with your purchase you may send it back within 7 days for an exchange or refund providing it is in the original packaging and condition.  You must not write on the packaging.   For your own protection we recommend the use of First Class Recorded Delivery.  Any loss of goods whilst being returned to The White Noise Machine Company will be deemed the responsibility of the sender and not The White Noise Machine Company.

The cost of delivering your item to you (£4.85 for a Marpac 980A and £7 for a Marsona 600A) will not be refunded.  You will also have to meet the cost of returning the item.

Limitation of Liability

The White Noise Machine Company, its partners, employees or other representatives will not be held liable for damages arising out of or in connection with the use of this site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.


Privacy Policy

The White Noise Machine Company respects your privacy.

We collect information about you to process your order and to provide you with the best possible service when visiting our website.

We do not send promotional e-mail or mail to you without your prior consent and never pass any of your information to third parties.

We do not send random marketing emails to personal e-mail addresses (spam).

The type of information we hold about you to enable us to provide a high quality service includes:

We will never collect sensitive information about you without consent and the information we have will be accurate and up to date.  If you are concerned that the information we hold about may be wrong please contact us and we will send you a copy of all the information held. If you find any inaccuracies please let us know and we will delete or correct it for you.

We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. It is advisable to delete cookies after each internet session.
